Part A: General part

1. PREAMBLE

   1.  Wunschgutschein GmbH, Bahnhofstraße 43, 59929 Brilon, represented by the managing directors Verena Argauer and Valentin Schütt, offers the sale and redemption of vouchers (“WISHCARD”) via the website https://wishcard365.com/ (“WISHCARD website ”) it operates  ) in accordance with these General Terms and Conditions (“WISHCARD General Terms and Conditions”).

2. SCOPE

   1. With the purchase of a transferrable WISHCARD, a right to redeem vouchers from our redeeming partners is established, with the nominal value of the WISHCARD corresponding to the nominal value of the voucher of a redeeming partner.
   2. WISHCARDS are ordered and redeemed exclusively in accordance with these WISHCARD General Terms and Conditions. Any general terms and conditions that conflict with or deviate from these General Terms and Conditions shall not apply.

3. OUR REDEMPTION PARTNERS

   1. You can find our redemption partners with whom WISHCARDS can currently be redeemed at  https://wishcard365.com/ .
   2. We are under no obligation to work with any particular redemption partner on an ongoing basis. If a previous redemption partner leaves the cooperation system, purchased WISHCARDS can no longer be redeemed for vouchers from the former redemption partner. This also applies in the event that a redemption partner was advertised as a redemption partner when purchasing the WISHCARD on the WISHCARD website or in retail.

4. LIABILITY

   1. We are liable for intent and gross negligence as well as for any culpable breach of a material contractual obligation (whereby the term material contractual obligation refers in abstract terms to such an obligation, the fulfillment of which is essential for the proper execution of the contract and the observance of which the other party can regularly rely on). , in the event of delay and impossibility. Liability according to this Section 4.1 is limited to the amount of the typically foreseeable damage in the case of financial loss and damage to property.
   2. The aforementioned limitations of liability do not apply in cases of mandatory legal liability, in particular under the Product Liability Act, when accepting a guarantee and in the event of culpable injury to life, limb or health.
   3. Please keep your WISHCARD safe and prevent unauthorized third parties from gaining knowledge of the code of your WISHCARD, as losing your WISHCARD or redeeming it without authorization is equivalent to losing cash. We assume no liability in the event of loss, theft or illegibility of WISHCARDS for which we are not responsible.

5. ON BILL

   Offsetting by the customer with counterclaims is only permitted in the case of undisputed or legally established claims.

6. JURISDICTION AND CHOICE OF LAW

   1. The place of jurisdiction for all legal disputes in the relationship between Wunschgutschein GmbH and the customer is Arnsberg, insofar as the customer is a merchant or a legal entity under public law. German law applies exclusively, excluding the UN sales law.

7. CHANGES IN THE TERMS AND CONDITIONS

   We reserve the right to make changes to the WISHCARD website and the WISHCARD terms and conditions at any time. The WISHCARD terms and conditions that are in force at the time of your order apply to your order and redemption of WISHCARDS.

8. CONTRACT TEXT STORAGE

   We save the text of the contract, send you the order data and our terms and conditions by e-mail. You can also view the General Terms and Conditions here on this page at any time. Your past orders are no longer accessible via the Internet for security reasons.

9. SEVERABILITY

   Should individual provisions of these General Terms and Conditions, including Part B and Part C, be or become wholly or partially invalid, the validity of the remaining provisions or parts of such provisions shall remain unaffected. Instead of the invalid or missing provisions, the respective statutory regulations apply.

Part C: Voucher Redemption Terms

1. SCOPE OF APPLICATION

   The following conditions for redeeming WISHCARDS apply to the redemption of WISHCARDS via the WISHCARD website.

2. SCOPE OF OUR OFFER

   1. Our WISHCARDS entitle you to redeem them for vouchers from our redeeming partners in the same amount (voucher nominal value). Issuer and debtor of the vouchers ordered by you in the course of redemption are the respective redemption partners who provide their services on the basis of their own contract under their own terms and conditions.
   2. We only owe you the sending of the voucher from the respective acceptance partner.
   3. The balance of a WISHCARD cannot be paid out and does not earn interest.

3. REDEMPTION PROCESS

   1. Zur Einlösung Ihres WISHCARDS geben Sie bitte auf der WISHCARD-Website im Bereich „Gutschein einlösen“ den auf der Rückseite des WISHCARDS abgedruckten Gutschein-Code („Mein Code“) ein und wählen einen der angezeigten Einlöse-Partner aus, bei dem Sie Ihren WISHCARD gegen einen Gutschein des ausgewählten Einlöse-Partners eintauschen möchten. Es werden ihnen danach angezeigt:
      1. sofern vorhanden die Einlöse-Partner, die exakt den gleichen Wert des WISHCARDS im Angebot haben, um eine 1 zu 1 Einlösung des Gutscheinwerts zu ermöglichen und
      2. optional die weiteren angebotenen Wertstufen dieses Partners, um die teilweise Einlösung des Gutscheinwerts zu ermöglichen oder, gegen eine Aufzahlung, eine Einlösung des Gutscheinwerts gegen einen höheren Gutschein des Partners.
   2. Nachdem sie einen Einlöse-Partner ausgewählt haben, wird ihnen ein Fenster gezeigt, wo sie den Button „Gutschein für diesen Shop anfordern“ klicken. Sollten sie diesen klicken, werden sie gebeten ihren Namen und die E-Mail-Adresse einzugeben. Zum Abschließen des Einlöse-Vorgangs müssen Sie die AGB sowie etwaige Sonderbedingungen für die Gutschein-Einlösung unserer Einlöse-Partner zur Kenntnis nehmen und akzeptieren sowie auf „Absenden & Gutschein anfordern“ klicken. In diesem Moment geben Sie das Angebot zur Einlösung Ihrer WISHCARD ab.
   3. Die Annahme Ihres Angebots erfolgt durch Bestätigung Ihrer Eingaben und Zusendung des Gutscheincodes des Einlöse-Partners. Je nachdem, welche Gutscheine Sie bestellt haben, erhalten Sie diese per Post bzw. E-Mail zugeschickt und können sie dann bei unseren Einlöse-Partnern einlösen. Die Einlösung der WISHCARD kann nur einmalig erfolgen und ist, nach Durchlaufen des oben genannten Prozesses, nicht mehr abänderbar. Ein Umtausch in Gutscheine anderer Einlöse-Partner ist mit Beendigung des Einlösevorgangs nicht mehr möglich.
   4. WUNSCHGUTSCHEIN behält sich vor, Gutscheineinlösungen zu sperren, zu blockieren oder für eine erweitere Prüfung zu verzögern, sofern dies für behördliche Anforderungen oder unternehmensinterne Prozesse wie Risikomanagement oder die Überprüfung von vertragsgemäßem Verhalten von Verkaufsstellen oder Nutzern notwendig ist.
   5. Die Einlösung des WISHCARDS muss auf eigenen Namen und eigene Rechnung erfolgen. Ein Kauf von WISHCARDS für die Einlösung in eigenen Namen ist nicht erlaubt.
   6. Die Nutzung von Rückvergütungen, Kick-Back-Zahlungen, Rabatte oder sonstige geldwerte Leistungen, die im Zusammenhang mit dem Erwerb des WUNSCHGUTSCHEINS gewährt werden und deren Zweck es ist, direkt oder indirekt einen Rabatt auf Einkäufe in den Partnershops zu erhalten, ist nicht zulässig.
   7. Der Erwerb des WUNSCHGUTSCHEIN zum Zwecke des Wieder- oder Weiterverkaufs ist nur mit vorheriger schriftlicher Zustimmung erlaubt. Hierzu zählt auch die Nutzung des WISHCARDS für den Erwerb von Gütern oder Dienstleistungen, die zum Zwecke des Weiter- oder Wiederverkaufs durch Einlösung des Guthabens auf einem oder mehreren WISHCARDS erworben werden.

4. LIEFERUNG DES GUTSCHEINES UNSERES EINLÖSE-PARTNERS

   1. Die Lieferung nach Einlösung der WISHCARD in den Gutschein einer unserer Einlöse-Partner erfolgt in der Regel innerhalb weniger Minuten per E-Mail. Bei postalischem Versand beträgt die Lieferzeit 1- 7 Werktage
   2. Wir liefern den Gutschein unseres Einlöse-Partners per E-Mail oder auf dem Versandweg mit der Deutschen Post, DHL oder DPD. Eine Selbstabholung der Ware ist leider nicht möglich.

5. GÜLTIGKEIT VON WISHCARDS

   WISHCARDS verfallen drei Jahre nach ihrer Bestellung beginnend ab dem Ende des Jahres, in dem die WISHCARD erworben wurde.
